Summary

Experience drafting and negotiating contracts and reviewing marketing content is essential.

Xsolla, a global leader in video game commerce, is seeking an experienced Advertisement Counsel to join our Legal Team. In this role, you will provide legal counsel and guidance on various aspects of advertising, marketing and privacy compliance. Your work will involve ensuring compliance with federal and state regulations, protecting Xsolla and its clients from legal risks and helping navigate the complex landscape of advertising law. You will work closely with marketing teams to develop and implement best practices that align with legal standards while promoting creativity and minimizing risk.

RESPONSIBILITIES

    • Compliance Review: Review marketing materials, contracts, online policies and advertising campaigns to ensure compliance with federal and state laws, including regulations from the Federal Trade Commission (FTC), Food and Drug Administration (FDA), and the National Organic Program (NOP).
    • Risk Mitigation: Provide strategic legal guidance on promoting products while minimizing exposure to potential legal risks. Identify potential legal issues early and propose solutions.
    • Regulatory Guidance: Assist in adhering to a wide range of regulatory requirements, including but not limited to FTC guidelines, FDA regulations, NOP standards and relevant consumer protection laws.
    • Privacy Law Compliance: Advise on privacy regulations such as the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and other relevant privacy laws. Ensure marketing strategies align with data protection standards.
    • Policy Development: Help develop internal protocols, practices and procedures to avoid missteps in our marketing and advertising practices. Draft, review and update relevant privacy policies, terms of service, and other related documents.
    • Training & Education: Conduct training sessions with Marketing and Legal Teams on advertising compliance, legal risks and how to spot and address issues proactively.

REQUIREMENTS

    • Licensed to practice law in California (CA) or New York (NY) with strong knowledge of relevant state and federal laws.
    • Strong understanding of advertising, marketing, consumer protection and privacy laws, particularly those from the FTC, FDA, and other regulatory bodies.
    • Proven ability to provide practical legal advice in a fast-paced business environment.
    • Excellent communication skills and the ability to work collaboratively with cross-functional teams, including marketing and business development.
    • Experience drafting and negotiating contracts, reviewing marketing content and assessing compliance with relevant advertising standards.
